Especially when it comes to the Government's burden to make its case beyond a reasonable doubt and not merely, maybe, could be or probably true?  Just something to think about.  I think I have won most of my acquittals in closing taking the time on this burden.]]></content>

		<content type="html"><![CDATA[Paul this is a prolific comment. I found myself doing this all too often. After going to several regionals and the college in '04 I finally realized that excuses are just that, excuses. Crying about bad juries, judges or opponents isn't going to solve anything. <BR> <BR>There are some cases that are very difficult. For instance med mal is really tough, but I like the challenge and the education it gives me about the human body and medicine. But no matter how good the cases seems they can be lost.<BR> <BR>We just need to learn to work harder and give it all we can. If we come up short, it shouldn't be for lack of effort.]]></content>

		<content type="html"><![CDATA[I followed the trial as best I could. A number of TLC grads did a very good job of posting updates on the alumni list serve almost daily. Norm's blog was OK too. I talked to a couple of people who attended the trial and they all said Gerry did a remarkable job. <BR> <BR>There was one particular prosecution witness who worked for Fieger. On direct examination he appeared to really hurt him. This witness said he had warned Fieger that making the contributions were illegal and that he refused to participate.<BR> <BR>What impressed me about Gerry's cross was how much background digging and plain old hard work had been done to get useful information on this witness. Gerry pointed out that the guy was a former state trouper, that he lost that job due to some misconduct, that Feiger hired him when the guy really needed a job, that Feiger had helped him financially a number of times, that Feiger was very generous with bonuses, that he always got bonuses, that over time he became a disgruntled employee, that he was repeatedly warned not to use the office computer for personal reasons, that he was eventually discharged or quit, that he had some sort of claim or a lawsuit against Feiger over his discharge, that it didn't turn out well, that he didn't go to to the FBI until after the claim went bad and also that one of things he put on his "my space" during work hours was an extremely rude comment about woman which Gerry read to the jury. There was a lot more that I can’t remember and this is all being done from memory so I'm my have a couple of items wrong. The point is that in the end the witness looked like a horses ass. The court room observers indicated that everyone there, jurors included, knew it.<BR> <BR>You are right about how a trial often turns on impressions, but good old hard work before the trial often shapes those impressions one way or another. Of corse being the best or at least arguably the best trial lawyer in America helps a great deal too.]]></content>

Gerry said this is his last trial and its time for him to put down his sword. It will be a long time before we see another as fine as "Gerry Spence"!]]></content>

I was the guy that did the "Fuck Bush" song/poem (don't remember if you were still there for it, but it was well received). I love your web site. There is a lot of good stuff here. Keep up the good work.<BR> <BR>If you ever have a chance I have a med mal case down here in Southren Calif. Wrongful death. Cardiologist failed to follow up after his cardiolite showed large areas of poor profusion. I have some evidence that he alteered records after his patient died. It went to trial in January. I worked with Josh Karton on it a bit. It ended in a 6-6 hung jury. I'm set for trial again in Oct. This doctor has the medical board after him for several things. He just was hit in another case. He is truely the "bad seed". If you have a chance I'd love to discuss it with you. See if you have some insight into what might put it over the top.
